Health and Clinical Data is special category personal data. We process it only where we have both a lawful basis under Article 6 of the UK GDPR and an applicable special category condition under Article 9.
Clinical Photography and Imaging: We may take photographs, videos, ultrasound images or other clinical images where reasonably necessary to:
- assess your condition or suitability for treatment;

Clinical photographs and images form part of your clinical record. They are processed for clinical purposes and are not dependent on marketing consent.

We will not use identifiable photographs, videos or clinical images for advertising, social media, promotional activity, testimonials, public presentations or similar non-clinical purposes unless we have obtained your separate and explicit consent.
Marketing consent is voluntary. Refusing or withdrawing that consent will not affect the care or treatment you receive.
You may withdraw marketing consent at any time. Withdrawal will stop future use under our control but will not affect processing that took place lawfully before consent was withdrawn. We may not be able to retrieve printed material or content already lawfully published or shared by third parties.
For the Aesthetic Complications Referral Centre, we will collect and process additional health data including complication details, ultrasound imaging records, treatment outcomes, and referral information. With explicit consent, these records may also be used for research and educational purposes as part of the complications clinic research tier.
Research, Education and Service Improvement
We may use information derived from clinical services to improve patient safety, treatment protocols, training and service quality.
Where information has been fully anonymised so that no individual can reasonably be identified, it is no longer personal data and may be used or shared for research, statistical, educational or service-improvement purposes.
Where identifiable or potentially identifiable clinical information, photographs or imaging are proposed for research or education, we will identify an appropriate lawful basis and Article 9 condition before the processing takes place.
Where explicit consent is the appropriate basis, participation will be voluntary and refusal will not affect your treatment or care.
Any formal research activity involving identifiable patient information must be subject to appropriate clinical, ethical, information-governance and contractual review.

In light of the services which we provide to You, it will often be necessary for us to use information about your health. Even in the broadest sense of the word, 'health' information is a special category of personal data which requires us to have an additional lawful basis for using this information. Where we use information about your health for the purpose of providing our services to you (or in preparation for us to provide services to you), the additional lawful basis on which we shall rely will be that such use is necessary in order for us to provide you with health care or treatment.

Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your Legal Rights In Detail
Under certain circumstances, You have rights under data protection laws in relation to your personal data.
- Request access to your personal data (commonly known as a "data subject access request"). This enables You to confirm with us whether your personal data is processed and, if it is, to receive a copy of the personal data we hold about you.
- Request correction of the personal data that we hold about you. This enables You to have any incomplete or inaccurate data we hold about You corrected, though we may need to verify the accuracy of the new data You provide to us.
- Request erasure of your personal data in certain circumstances. This enables You to ask us to delete or remove personal data where it is no longer necessary for us to continue to process it. You also have the right to ask us to delete or remove your personal data where You have successfully exercised your right to object to processing (see below), where we may have processed your personal data unlawfully or where we are required to erase your personal data to comply with applicable law. However, the right to erasure is not an absolute right and we may not always be required to comply with your request for specific legal reasons which will be notified to you, if applicable, at the time of your request.
- Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party). In some cases, we may demonstrate that we have compelling legitimate grounds to process your personal data which override your rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes.
- Request restriction of processing of your personal data in certain circumstances. This enables You to ask us to suspend the processing of your personal data in the following circumstances:
- If You want us to establish the data's accuracy;
- Where our use of the data is unlawful but You do not want us to erase it;
- Where You need us to hold the data even if we no longer require it as You need it to establish, exercise or defend legal claims; or
- You have objected to our use of your personal data or performing profiling activities when relying on a legitimate interest but we need to verify whether we have overriding legitimate grounds to use it.
- Request the transfer of your personal data to You or a third party. We will provide to you, or a third party You have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to personal data processed by automated means which You initially provided consent for us to use or where we used the information to perform a contract with you.
- Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before You withdraw your consent. If You withdraw your consent, we may not be able to provide certain products or services to you. We will advise You if this is the case at the time You withdraw your consent.
You have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns in the first instance.
